This Agreement is a contract between you and Pulse Track App (“we,” “our,” or “us”) and outlines your and our rights before you use our application (the “App” or “Software”) and related services (the “Service”). Please take a moment to read these Terms carefully before using the App. By accessing, viewing, or using the App, you are consenting to the terms and conditions described in this document. If you do not agree with this Agreement, please stop using the App immediately.1. End User License Agreement1.1 Scope of the App License1. License Grant: We grant you a personal, revocable, non-transferable, and non-exclusive license to use the App. Unless otherwise expressly agreed in writing, you are permitted to install, use, display, or run the App or use the Service on your smart mobile end-device, such as a smartphone or tablet (“end-device”), for non-commercial purposes.2. Prohibited Uses: You may not use the App under the following conditions:- You shall not create derivative works from the App or commercially exploit the App, in whole or in part, in any way.
- You shall use the App for lawful purposes only.
- You shall not use, sell, modify, or distribute the App except as permitted by the functionality of the App.
- You shall not engage in behaviors that jeopardize computer network security, including but not limited to: unauthorized data use, unauthorized server/account access, deleting or modifying stored information without permission, attempting to interfere with the normal operation of the App, or introducing malware or viruses.
- You shall not use the App in a way that may cause damage, suspension, overloading, or quality reduction of the App (or servers and internet connected to the App).3. Unauthorized Actions: You may not copy, grant a sub-license, share, or sell the App or the Service to any third party. You are responsible for any fees or expenses arising from unauthorized use.4. License Termination: We reserve all rights not expressly granted to you, and this license may automatically terminate if you violate any of these restrictions. This license may be terminated by us at any time at our sole discretion.1.2 Privacy and Personal Information1. Respect for Privacy: We respect the privacy and personal information of each user and will protect your data in accordance with applicable laws, including those related to data protection. Please carefully read our Privacy Policy to understand how we collect, use, process, and store your personal information.2. Permissions: The App may request permission to access certain data, such as heart rate information, during regular operation. If additional permissions are required, we will ask for your consent in advance.1.3 No Medical AdviceThe App is provided for educational and entertainment purposes only and is not intended to diagnose, treat, cure, or prevent any medical condition. To the fullest extent permitted by applicable law, you agree that we are not providing medical or healthcare advice through the Service, including advice relating to nutrition, weight loss, or wellness. You should always seek the advice of a licensed physician regarding any medical conditions. Your use of the App indicates that you accept full responsibility for your health and understand that activities such as diet and exercise carry risks, including the risk of injury or death.1.4 Certain RestrictionsThe rights granted to you in this Agreement are subject to the following restrictions:- You shall not license, sell, rent, lease, transfer, assign, distribute, host, or commercially exploit any part of the App.
- You shall not modify, translate, adapt, merge, create derivative works from, disassemble, decompile, reverse-compile, or reverse-engineer any part of the App.
- You shall not access the App to build a similar or competitive service or application.
- You shall not remove or destroy any copyright notices or other proprietary markings contained on or in the App.1.5 Local LawsYou are solely responsible for compliance with all applicable laws, including but not limited to export and import regulations.1.6 Modifications to the AppPulse Track App reserves the right to modify, suspend, or discontinue the App or any part thereof at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App or any part thereof.1.7 OwnershipThe App is licensed, not sold, to you. Pulse Track App (and its licensors, where applicable) retains all rights, title, and interest, including all related intellectual property rights, in and to the App. This Agreement does not convey to you any rights of ownership in or related to the App. The Pulse Track name, logo, and product names associated with the App belong to Pulse Track App (or its licensors), and no right or license is granted to use them by implication, estoppel, or otherwise. All rights not expressly granted are reserved by Pulse Track App.2. User Content2.1 Content Guidelines1. User Content: As a user, you may submit content such as graphics, photos, or other materials (“Content”). You acknowledge that we do not guarantee confidentiality for any Content you submit.2. License of Content: By submitting Content, you grant Pulse Track App a royalty-free, perpetual, irrevocable, transferable, worldwide, non-exclusive license to use, sublicense, reproduce, modify, publish, and distribute such Content.3. Responsibility for Content: You are solely responsible for the Content you submit and represent that you own or have the necessary licenses, rights, consents, and permissions to submit such Content.2.2 Paid Services1. Paid Services: Certain Services provided by the App may require payment (“Paid Services”). These may include subscriptions or additional features.2. Payment Processing: Payments are managed by third-party providers such as Apple, and you must comply with their terms and policies.3. Third Parties3.1 Application StoresThe App’s availability depends on third-party stores (e.g., Apple App Store). This Agreement is between you and Pulse Track App, not with the Application Store. The Application Store is not responsible for the App’s content, maintenance, or support.3.2 Third-Party ServicesThe App may include content from third parties. Pulse Track App does not control third-party services and is not responsible for their content, functionality, or policies.4. Disclaimer- General Disclaimer: Pulse Track is designed for fitness use and general health information only. It is not intended for medical use, diagnosis, prevention, or treatment of any condition.
- Limitations of App Functionality: The App helps you monitor your heart rate but does not directly measure blood pressure or blood oxygen levels.
- Medical Advice: Always consult with a healthcare professional for medical advice if you have any health concerns5. Limitation of LiabilityTo the maximum extent permitted by law, Pulse Track App is not liable for any indirect, incidental, special, or consequential damages arising from or related to your use or inability to use the App.6. Changes to These TermsPulse Track App reserves the right to modify these Terms at any time. We will notify you of any material changes, and your continued use of the App after such changes will constitute acceptance of the new Terms.7.
